ABSTRACT
The regulation of the use of mariguana is a very important on-going debate in Mexico nowadays. There are two approaches: the prohibicionist and the permissionist. A recent Supreme Court ruling has opened the door to a permissionist view of the use of this narcotic, based on the free development of the person principle. This article participates in this debate departing from the problematization of the consequences of the criminalization against mariguana users, as well as the importance of the recognition of the discrimination they face.
